Acceptable Use Policy

Rules and restrictions that govern acceptable use of the OpoShop platform and services operated by EverBee, Inc.

This Acceptable Use Policy (“AUP”) sets out the rules that apply to your use of the OpoShop platform and any services provided by OpoShop. OpoShop is a product owned and operated by EverBee, Inc. (“OpoShop”, “we”, “our” or “us”).

This AUP is incorporated by reference into the OpoShop Terms of Service and forms part of the binding agreement between you and OpoShop. By using the Services you confirm that you accept this AUP and will comply with it. If you do not agree to this AUP, you must not use the Services.

Prohibited activities

You must not use OpoShop to engage in, facilitate, or promote any of the following:

Illegal or harmful content

  • Any activity that is unlawful, fraudulent, or harmful, or in connection with any unlawful, fraudulent, or harmful purpose or activity.
  • Content that violates any applicable local, national, or international law or regulation.
  • Content that is defamatory, obscene, offensive, hateful, or inflammatory, or that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Content that contains or promotes violence, terrorism, or extremism of any kind.
  • Content that is sexually explicit or pornographic, or that sexually exploits or endangers minors in any way. We will report any such content to the relevant law enforcement authorities.
  • Content that promotes, sells, or distributes illegal drugs, controlled substances, or paraphernalia.
  • Content that promotes, sells, or distributes firearms, ammunition, or weapons in violation of applicable law.

Intellectual property infringement

  • Selling or distributing counterfeit goods, pirated software, or any other content that infringes the intellectual property rights (including copyright, trademark, patent, and trade secrets) of any third party.
  • Using any trade mark, logo, or other proprietary information of OpoShop, EverBee, or any third party without the express written permission of the owner.
  • Removing, obscuring, or altering any copyright or other proprietary notices contained in or on the Services.

Platform abuse and security

  • Transmitting any unsolicited or unauthorised advertising or promotional material, or any other form of similar solicitation (spam).
  • Knowingly transmitting any data or sending or uploading any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
  • Attempting to gain unauthorised access to any part of the Services, the server on which our site is stored, or any server, computer, or database connected to our site.
  • Attacking our site via a denial-of-service attack or a distributed denial-of-service attack.
  • Attempting to reverse-engineer, decompile, disassemble, or otherwise derive source code from any portion of the Services.
  • Scraping, crawling, or using any automated method to collect data from the Services without our prior written consent.
  • Creating or registering multiple accounts to circumvent limits, bans, or restrictions imposed by OpoShop.
  • Misrepresenting your identity, impersonating any person or organisation, or falsely stating or otherwise misrepresenting your affiliation with a person or organisation.

Prohibited products and services

You must not use OpoShop to sell, list, advertise, or distribute the following products or services, regardless of whether such products or services are legal in your jurisdiction:

  • Counterfeit goods or goods that infringe any intellectual property rights, including unauthorised replicas of branded merchandise.
  • Tobacco, e-cigarettes, vaping products, or related paraphernalia (where restricted by applicable law).
  • Hazardous, toxic, or flammable materials.
  • Human remains or body parts.
  • Financial products, investment schemes, or “get-rich-quick” programmes that are fraudulent or violate applicable financial regulation.
  • Any product or service that requires a licence or regulatory approval that you do not hold.
  • Any product or service that OpoShop reasonably determines, at its sole discretion, poses unacceptable legal, reputational, or other risk to OpoShop or the wider community.

Data privacy

  • Collecting, storing, or processing personal data of your customers or visitors in violation of any applicable data protection law, including the GDPR, CCPA, or any other applicable privacy regulation.
  • Using customer data obtained through your OpoShop store for purposes other than operating your store, fulfilling orders, and communicating with your customers in accordance with your own privacy policy.
  • Selling, renting, or otherwise transferring personal data obtained through your OpoShop store to third parties for their own marketing purposes.

Because OpoShop is specifically built for print-on-demand sellers, the following additional rules apply to all print-on-demand product listings and fulfilment:

  • No infringing artwork. You must own or hold a valid licence for all artwork, designs, text, and other creative content you upload or print. Using unlicensed fan art, trademarked characters, celebrity likenesses, or copyrighted images without authorisation is strictly prohibited.
  • Accurate product descriptions. You must accurately describe all products, including materials, sizes, print quality, and estimated fulfilment times. You must not make false or misleading claims about your products.
  • Compliant fulfilment. You are responsible for ensuring that the products you fulfil through connected POD providers comply with the terms of those providers and with applicable laws in the destination countries (including import, customs, and consumer protection laws).
  • Customer protection. You must honour your stated returns, refunds, and exchange policies and must not deceive or harm your customers.

Monitoring and enforcement

OpoShop does not actively monitor all content or activities conducted through the platform, but we reserve the right (though not the obligation) to review any content and investigate any alleged violation of this AUP.

If we determine that a violation of this AUP has occurred, we may, without limiting any other remedies available to us:

  • Issue a warning to the user;
  • Suspend or terminate the user’s account and access to the Services;
  • Remove or disable access to any content that violates this AUP;
  • Report the activity to relevant law enforcement or regulatory authorities; and/or
  • Take legal action against the user.

We will not be liable for any loss or damage caused by a failure to detect a violation or by any action we take in response to a violation.

Reporting a violation

If you become aware of any content or activity on the OpoShop platform that you believe violates this AUP or any applicable law, please report it to us at hello@everbee.io. We will investigate all legitimate reports.

Changes to this policy

We may revise this AUP from time to time. The “Last updated” date at the top of this page reflects when this policy was last changed. Where revisions are material, we will provide reasonable notice by email or via a notice on the OpoShop dashboard. Your continued use of the Services after such notice constitutes acceptance of the revised AUP.
